Terms & Conditions

Definitions The following terms are defined for use throughout this agreement. Any terms not explicitly defined should be interpreted using logical reasoning and sound judgment.

  • Storage Plan or Custom Plan: The specific storage plan associated with each designated Property.
  • Box or Boxes: The cartons used for storing your belongings, including those provided by us ("Company-Provided Box") as well as those supplied by you.
  • Tape: Packing tape used to seal a Box, which includes tape supplied by us ("Company-Provided Tape") as well as your own.
  • Website: Our official website located at www.studentstoragepros.com and all associated web pages under the domain.
  • Company Supplies: All packing materials provided under this Agreement, including Company-Provided Boxes, Company-Provided Tape, and other packaging supplies.
  • Property: All items stored with us under this Agreement, including items contained within a Box, the Box itself, standalone items, and items stored as part of a Custom Plan.
  • Services: The range of services we provide, including but not limited to box drop-off, pick-up, labor and transportation, storage, and delivery.
  • Appointment Dates: Any scheduled date on which we interact with you, such as for Box Drop-Off, Pickup, or Delivery.
  • Start Date: The date when we collect Boxes or other Property from you.
  • Storage Term: The period for which storage is billed, measured in one-month increments, beginning on the Start Date.
  • Box Drop-Off Dates: Dates when Company Supplies (e.g., Company-Provided Boxes) are delivered to you.

Term & Minimum Storage Requirement This Agreement takes effect on the Start Date and remains in force until terminated. A minimum storage term of four (4) months applies. After this period, the Agreement continues on a month-to-month basis until either party terminates it.

If you request retrieval of your stored items before the minimum term ends, you will be charged for the remaining storage period before delivery is completed.

Modifications We reserve the right to update this Agreement and our policies at any time. Changes take effect upon posting on our Website. Continued use of our Services constitutes acceptance of these changes.

Scheduling of Services All Services must be scheduled in advance via our Website or by contacting us directly. Availability displayed online may not always be accurate, and we cannot guarantee specific time slots. Scheduling is subject to our availability and discretion, and we reserve the right to modify or cancel Appointment Dates.

You or an authorized individual must be present at the designated address at the scheduled time for pickup or delivery. Failure to do so will result in the service being marked as completed, and you will be charged accordingly, including a cancellation fee. You may cancel a scheduled Service without penalty if you provide at least 72 hours' notice (unless you have received Company Supplies, in which case cancellation fees may apply).

Pricing & Storage Charges Our pricing is published on our Website and may be adjusted at any time.

Storage is billed per item (e.g., per Box or standalone Property) on a monthly basis, with a minimum commitment of four (4) months. Charges automatically renew each month until termination.

Storage fees are non-refundable and are not prorated for partial months. Final categorization of items is determined at our discretion, and we reserve the right to reclassify items and adjust fees accordingly.

Customers creating "Custom Items" based on dimensions must provide accurate measurements. We may verify item sizes and adjust charges as needed. If your actual storage volume exceeds your selected Storage Plan, we may upgrade your plan and adjust charges accordingly.

Refunds are available within seven (7) days of purchase, minus a 5% processing fee, provided no storage has commenced. After this period or within 72 hours of a scheduled Box Drop-Off or Pickup Date, refunds are not available.

Non-Storage Charges Additional fees apply for services such as appointment rescheduling, late arrivals, missed appointments, policy violations, and transportation of items. These fees are listed on our Website and may be determined on a case-by-case basis.

Taxes All charges are subject to all applicable taxes

Payment & Overdue Accounts You authorize us to charge all fees to your stored payment method. If a payment fails, we will attempt to process it again within seven (7) days. If payment is still not received, an Overdue Payment Fee applies. Accounts more than 45 days overdue are considered abandoned, and all stored items become our Property.

Responsibility for Property & Packing You are responsible for:

  • Inspecting and properly packing your items before pickup.
  • Sealing all Boxes securely with Tape.
  • Cushioning fragile items to prevent damage.
  • Labelling each Box clearly on all four sides.
  • Verifying item descriptions.

We are not liable for ordinary wear and tear, shifting during transit, or cosmetic damage to items such as suitcases or baggage. Additionally, we do not assume liability for damage to electronics, fragile items, antiques, or artwork.

Weight Limits Each item or Box must not exceed 49 lbs. Items 50 lbs or more are considered "Heavy Items" and may be refused. Items 70 lbs or more will not be accepted. If an item is determined to exceed the limit, a Heavy Item Fee of $125 plus taxes will apply.

Right to Refuse Items & Entry We may refuse to store items that are oversized, improperly packed, unclean, or unsuitable for transport. Additionally, we reserve the right to refuse entry to premises deemed hazardous or unsanitary. Any mattress not fully sealed in a protective cover may be rejected.

Limitation of Liability

Maximum Declared Value of Property

You acknowledge and agree that the total declared value of all items stored, transported, or handled by Student Storage under this Agreement shall not exceed $0.50 per pound, with a maximum overall limit of $250, unless otherwise agreed in writing by Student Storage and subject to adjusted pricing.

Limitation of Liability for Loss or Damage In the rare event of loss, damage, or destruction of stored items, Student Storage will only be liable if the damage results from negligence that a reasonably careful person would avoid under similar circumstances. If found liable, Student Storage’s responsibility is limited to a maximum of $0.50 per pound, up to an aggregate total of $250.

Insurance Policy Eligibility Criteria

For an item to be covered under our insurance policy, it must meet the following conditions:

  • It cannot be classified as a Fragile Item, Valuable Item, Item of Exceptional Value, or Prohibited Item as outlined in our Fragile Items Policy and Terms of Use.
  • It must be readily replaceable and not derive its value from uniqueness, rarity, historical significance, or sentimental attachment.
  • You must declare its replacement value via email (contact@studentstoragepros.com), with reasonable supporting documentation, and ensure the stated value falls within our insurance coverage limits. Student Storage reserves the right to reject storage of any item we determine, at our sole discretion, to have an inaccurate declared value.

Student Storage is not liable for any damage to Fragile Items, as defined in our Fragile Items Policy. These include, but are not limited to, televisions, monitors, computers, audio/visual equipment, antiques, and select artwork. Furthermore, while we take great care in handling your belongings, Student Storage is not responsible for cosmetic wear and tear on suitcases or baggage, including scratches, scuffs, stains, dents, or dirt. Additionally, we are not liable for damages resulting from overpacking or the use of low-quality storage materials, such as weak boxes or poorly constructed luggage.

OUR PROTECTION PLANS LIMIT LIABILITY FOR DAMAGES TO FRAGILE ITEMS. BY UTILIZING STUDENT STORAGE SERVICES, YOU AGREE TO THE TERMS OF OUR FRAGILE ITEM POLICY, FRAGILE ITEM WAIVER, AND VALUABLE ITEMS POLICY, AS WELL AS ALL CONDITIONS OF OUR INSURANCE AND PROTECTION PLANS, INCLUDING LIABILITY LIMITATIONS FOR FRAGILE ITEMS.

No Liability for Consequential Damages Student Storage shall not be responsible for any consequential, incidental, special, or punitive damages, regardless of the legal theory under which such claims are made.

Termination Policy Either party may cancel this Agreement within seven (7) days of purchase and up to seventy-two (72) hours before the scheduled Box Drop-Off or Pickup Date, provided no Boxes or Supplies have been received. If canceled within this window, You may be eligible for a full or partial refund, subject to a 5% processing fee. Cancellations outside of this timeframe are non-refundable.

Prohibited Property and Hazardous Substances

You agree not to store with Student Storage or place in Boxes any of the following:

  • Living things, fragile materials, perishables, or liquids
  • Firearms, explosives, or flammable substances of any kind
  • Drugs, drug paraphernalia, stolen items, or illegal items
  • Materials that may attract vermin or insects
  • Hazardous or unsafe items, including those regulated by federal or provincial laws
  • High-value items such as:
  • Valuable documents, cash, bills, currency, deeds, evidence of debt, negotiable instruments, or check stock
  • Jewelry, watches, gems, precious or semi-precious metals or stones
  • Antiques, artwork, paintings, statues, fine art, furs, or similar valuables

Student Storage reserves the right to refuse pick-up or request immediate removal of a Box or Property if:

  1. It contains prohibited Property or hazardous substances.
  2. It poses a risk to safety, security, or other stored Property.

Temperature and Climate Control

Student Storage will use reasonable efforts to maintain an appropriate temperature and climate within its storage facilities. However:

  • We do not guarantee mold, mildew, or similar microorganisms will not develop.
  • We are not liable for any damage caused by such occurrences.
  • You assume the risk that environmental conditions could impact your Property.

Right to Inspect

Student Storage reserves the right to inspect the contents of your Boxes and Property in the following cases:

  • In the event of an emergency or suspected criminal activity.
  • If prohibited Property is suspected.
  • If you default on your obligations under this Agreement.
  • If required by a subpoena, search warrant, or government order.

We shall not be liable for any loss or damage resulting from compliance with legal or regulatory orders.

Ownership Warranty

You warrant that:

  • You are the legal owner of the stored Property.
  • You have full authority to store it under this Agreement.

If a dispute arises concerning ownership or disposition of your Property, you will reimburse Student Storage for any reasonable costs incurred, including legal fees.

Lien and Security Interest

Student Storage claims a general lien on all stored Property for:

  1. Storage and service charges (past, present, and future).
  2. Expenses necessary to preserve your Property.
  3. Costs related to enforcement of this Agreement, including legal fees.
  4. Expenses incurred in the sale of your Property, if applicable.

To the fullest extent permitted by law, Student Storage reserves a security interest in all stored Property as collateral for unpaid charges.

Disposal or Sale of Property upon Default

  • If you fail to pay for storage services when due, you will be in default.
  • Student Storage will send a written notice of default via email.
  • If payment is not made within the specified time, we may sell or dispose of your Property.
  • You will be responsible for any related costs incurred by Student Storage.

Photography, Audio, and Video Recording

By using Student Storage services, you consent to:

  • Photography, audio, and video recording of you, your Property, and residence.
  • Use of such media for promotional purposes, including social media.
  • Waiving any claims for payment or royalties related to such use.
  • Waiving any right to approve any form of media recorded by Student Storage or the person or entity designated to do so by Student Storage.

Waiver

If Student Storage waives its right to enforce any term under this Agreement, such waiver applies only to that instance and does not waive future rights.

Release of Your Information

Student Storage may disclose information related to your Property:

  • If required by law or a government agency.
  • To comply with law enforcement requests or court orders.

Limited Warranty and Disclaimer

Student Storage warrants that:

  • Services will be provided in a professional manner by trained personnel.
  • No other warranties, express or implied, apply.

We expressly disclaim warranties of merchantability or fitness for a particular purpose.

Governing Law

This Agreement shall be governed by the laws of the region where services are provided, without regard to conflict of law principles.

Notice of Loss, Damage, or Destruction

  • You must notify Student Storage as soon as possible if your Property is lost, damaged, or destroyed.
  • Any claim must be filed within one (1) week of:
  1. The delivery or return of your Property.
  2. Notification from Student Storage of loss, damage, or destruction.

Notices

  • Student Storage will send notices to the email or phone number provided by you.
  • Notices are deemed given when sent.
  • You must promptly notify Student Storage of any changes to your contact details.

Other Rights

Student Storage reserves all rights and remedies available under this Agreement and applicable law.

Severability

If any term of this Agreement is found to be unenforceable, it shall be modified to the least extent necessary to be enforceable, and all other terms shall remain in effect.

Survival

Any provision that imposes an obligation after termination shall survive termination of this Agreement.

Permission to Communicate

By entering into this Agreement, you consent to:

  • Receiving communications via phone, text, email, and social media for business and collection notices.


Force Majeure

Neither party shall be liable for failure to perform due to events beyond reasonable control, including but not limited to:

  • Acts of God, natural disasters, severe weather
  • Government actions, labor unrest, riots
  • Acts of terrorism, traffic delays

Subcontracting and Assignment

  • Student Storage may subcontract services or assign this Agreement without prior notice.
  • You may not assign this Agreement without Student Storage’s written consent.

Entire Agreement

This Agreement:

  • Constitutes the entire understanding between You and Student Storage.
  • Supersedes all prior oral or written agreements.
  • Governs to the exclusion of any conflicting terms and conditions.

By using Student Storage’s services, you acknowledge and agree to these Terms & Conditions.
